ENTRY INSTRUCTIONS:
Information on how to enter and the prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

COMPETITION PERIOD: The Competition commences on Friday 12th November 2021 at 00:01 (AEDT) and concludes on Tuesday 30th November 2021 at 23:59 (AEDT).
ELIGIBLE ENTRANTS:
Entry into this Competition is only open to persons who are:
Australian, European, American or New Zealand residents.
Aged 18 years and over at the start of the competition period.
HOW TO ENTER:
To enter, entrants must, during the Competition Period, complete the competition Entry Form.
By entering the Competition, Entrants also consent to join the Haydenshapes, Wasted Talent and Former brand newsletter programs simultaneously, regardless of which website that entrant completed the competition entry form. Terms and Conditions of each loyalty rewards program and/or newsletter program can be found by visiting the brand’s website (see below) for links to each brand’s website. Entrants can opt-out of email communications at any time by unsubscribing from each respective mailing list.

Each Eligible Entrant who submits a valid entry form on either Haydenshapes, Wasted Talent or Former brand websites will be entered into the draw. Any costs associated with entering this Competition are the responsibility of each Entrant.
LIMITS OF ENTRY: Each Eligible Entrant may enter up to three times across either Haydenshapes, Wasted Talent or Former brand websites, i.e entrants may submit one (1) entry form for each brand.
PRIZE DRAWS:
There will be one prize draw that will take place at 11:00 AEDT on Thursday 2nd December at Former Merchandise, 3/94 Township Drive Burleigh Heads, QLD, Australia 4220,
The prize draw will have one (1) winner and two (2) runner-ups.
PRIZE DETAILS:
First Prize: Craig Anderson's Limited Edition Wasted Talent x Haydenshapes 5’7 Cohort I surfboard, signed by Craig. Please note, this is Craig's actual surfboard, waxed and gripped. Value: $1,549.00 AUD
Runner-up Prize: (2x Recipients)
FORMER x Wasted Talent Prize back to the value of $500 AUD.
*All prize values are inclusive of GST.
NOTIFICATION OF WINNERS:
Winners will be notified within two (5) business days of the draw. The winners will be notified of their Prize in writing via email. Winners will also be published online from Monday, 6th December 2021 and on social media.
SECOND CHANCE DRAW:
If a winner does not respond within seven (7) calendar days of the Prize draw or is not able to satisfy the eligibility criteria to the Promoter’s satisfaction, then their Prize shall be deemed unclaimed.
The Promoter reserves the right to conduct a redraw in the event a winner does not claim their Prize or is not able to satisfy the eligibility criteria. In such circumstances, and subject to any direction under relevant State legislation, a second chance draw will occur at 11:00 AEDT on Thursday 9th December 2021 at Former Merchandise, 3/94 Township Drive Burleigh Heads, QLD, Australia 4220.
The winners will be notified within two (2) business days of the second chance draw. The winners will be notified of their Prize in writing via email.

PRIZE LIMITATIONS:
The Prize is not transferable and is not redeemable for cash. The Prize must be taken as stated, and no compensation will be paid if a Winner is unable to use the Prize.
The Prize cannot be transferred to any other person, unless agreed to by the Promoter.
PRIVACY:
The Promoter will use Entrants' personal information in order to conduct the Competition, awarding any Prizes and publishing the winner’s details for notification purposes. Winners consent to the Promoter providing the Winners' personal information to third parties such as the prize suppliers (for the purposes of providing the Prize) and any applicable regulatory authorities. If the information requested is not provided, the Entrant may not participate in the Competition.
By entering the Competition, the Entrant also consents to the Promoters (Haydenshapes, Wasted Talent, FORMER) using the entrant's personal information to provide information about their products and services (including via email). Entrants can opt-out at any time by following the instructions on the Privacy Policy page for each respective promoter / brand.
By entering the Competition, Entrants also consent to join the Haydenshapes, Wasted Talent and Former brand newsletter programs simultaneously. Terms and Conditions of each newsletter program can be found by visiting the brand’s website (refer section 6 (How to Enter)) for links to each brand’s website. Entrants can opt-out at any time by following the instructions on the Privacy Policy for each respective promoter / brand.
The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Promoter's privacy policy, available at:

Entrants consent to the Promoter using the Entrant's name, likeness, image and/or voice in the event that they are a Winner (including photograph, film, file and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome), unless Winner notifies Promoter at time of accepting the Prize that they do not want their personal information to be used for these purposes.
LIMITATIONS OF LIABILITY:
The Promoter and the Prize suppliers shall not be liable for any loss, damage or injury suffered or sustained as a result of accepting and/or using a Prize in relation to the Competition, except for any liability which cannot be excluded by law.
Any Prize supplied by a third-party supplier is subject to the terms and conditions of that third party supplier. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of any third-party supplier or otherwise as a result of the winner accepting and/or using the Prize, except for any liability which cannot be excluded by law. Nothing in these conditions restricts, excludes, or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth) or Consumer Guarantees Act 1993 (NZ).
If in the conduct of this Competition, the Promoter is liable for a breach of any guarantee, warranty, condition, or other terms that applies under the Competition and Consumer Act 2010 (Cth) or Consumer Guarantees Act 1993 (NZ) or is implied by any other commonwealth, state or territory law that cannot be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or Prize won.
Without limiting the previous paragraph, the Promoter and the prize suppliers will not be liable for any damage, loss, or delay in transit of the Prize.
ADDITIONAL:
This Competition, or any aspect of it, may be changed or withdrawn by the Promoter at any time without prior notification. The Promoter reserves the right to verify the validity of entries (including an individual’s name, location and age) at any time and to disqualify any entrant who tampers with the entry process.
Any amendment, cancellation or withdrawal of the Competition will not occur without the prior written approval of the Gaming and Wagering Commission.
The Promoter's decision is final, and the Promoter will not enter into correspondence regarding the Competition result.
Any attempt to deliberately damage the Promoter's website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this Competition may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages, and costs.
Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these terms and conditions or affecting the validity or enforceability of that provision in any other jurisdiction.
These terms and conditions are governed by and are to be construed in accordance with the laws enforceable by each state of Australia. Each party submits to the exclusive jurisdiction of the courts exercising jurisdiction in each state of Australia, and any court hearing appeals from those courts.
Entry and continued participation in the Competition is dependent on Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at https://www.facebook.com/terms.php and Instagram’s Terms of Use, which can be viewed at https://help.instagram.com/478745558852511.
Entrants release Facebook and Instagram and its associated companies from all liability arising in respect of the Competition and acknowledge that:
The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram;
Any information provided by the Entrant in connection with the Competition is provided to the Promoter and not Facebook or Instagram; and
Any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook or Instagram.

Delivery times vary depending on location and order type. Higher volumes of orders are being processed. Please note the following estimated timelines:

2. Can I ship to a PO Box? Surfboards cannot be shipped to PO Boxes. Additionally, if you are using a third-party address, Haydenshapes must verify it.
3. What if I miss my delivery? Please ensure someone is available at your delivery address. The customer is responsible for any re-delivery costs if a delivery is missed.

4. Can I return a surfboard?
Custom and made-to-order surfboards, limited editions, and sale boards are not eligible for returns. Other surfboards can be returned within 7 days, with a 15% or $150 restocking fee, whichever is greater.
5. What is the return policy for clothing, hardware, and accessories?
Haydenshapes accepts returns on full-priced items within 30 days, provided they are in original condition with tags attached. Sale items and items purchased with a discount code are not eligible for return.
6. Do you offer exchanges?
Size exchanges are available for wetsuits (provided they haven’t been used in water). Clothing exchanges are offered to customers in Australia and New Zealand only and are limited to size changes on the same item.
7. How do I report damaged or incorrect items?
If you receive a damaged or incorrect item, please contact Haydenshapes within 24 hours via email or through our customer service form here.
8. Do I need to cover return shipping?
Yes, customers are responsible for return shipping costs. Shipping fees are non-refundable.

Our wetsuits come with a limited 1-year warranty covering workmanship and materials. If the product is found defective under normal use, Haydenshapes may repair or replace it.
2. How do I choose the right surfboard size?
Our team is available to help you find the best surfboard based on your skill level and surfing goals. Feel free to reach out for personalized recommendations.
3. Can I request custom surfboard artwork?Yes, custom artwork is available through our HS Studio service. Please note that custom orders cannot be cancelled or returned once placed.
1. Can I change my order after it’s been placed?
Due to fast processing times, changes to orders may not be possible. Contact us immediately, and we’ll do our best to assist. If your order has already shipped, you will need to contact the carrier directly to make any address changes.
2. What payment methods are accepted?
We accept major credit cards, PayPal, and various international payment methods. If you need help with payment, please reach out to our team.
3. Will I have to pay import duties or taxes for international orders?
For international orders, the recipient is responsible for any duties or taxes applied at import. Please contact us before ordering if you’d like an estimate.
4. Can I use a discount code on sale items at Haydenshapes? Typically, discount codes cannot be used in combination with existing sales or discounts at Haydenshapes. Sale items are usually excluded from the use of additional promo codes.
